The company Masal S/A Indústria e Comércio is obliged to pay Microsoft and Autodesk Incorporated five times the sales value of each reproduction of the pirated computer programs it used. The decision is from the 1st Section of the Superior Court of Justice.
Masal appealed to the STJ against the Special Data conviction imposed by the Court of Justice of Rio Grande do Sul. It claimed that the compensation went beyond reasonableness and would lead to serious financial difficulties. He also argued that a new expert opinion was requested, but the request was not granted.
Minister Hélio Quáglia Barbosa, rapporteur, did not accept the arguments. The expert opinion, because the preliminary was not discussed in the second instance decision; that of compensation, because he understood that the value is neither negligible nor exaggerated.
In addition to the reparation, the company will have to pay for illegally used programs and stop using pirated ones, under penalty of a daily fine of 20 minimum wages.
